How can a consumer lodge a complaint?

What is A Consumer Court in India?

The Consumer Court is a court established under the Consumer Protection Act, 1986 to resolve and resolve disputes in India.

These courts are established at three levels, namely, District, Provincial and national levels.

Legally, a dispute is filed in these courts according to the amount of money, i.e. each Court has a statutory value.

Consumers are the backbone of the economy because of their ability to buy goods and services.

Ideally, goods and services should be of a certain quality and free from defects or deficiencies in nature. However, there are many cases where the Consumer is a victim of poor service or substandard goods. To prepare the consumer and to provide for the reconstruction process, the Consumer Protection Act, 1986 came into force.

 

Procedure for lodging a complaint with the Consumer Court

STEP 1: Intimation by Notice

Notice to be sent by the victim to the service provider who provided the goods or services. The notice indicates the complainant’s intention to use the charges and notify him or her of any misconduct or lack of service or any other misconduct. Notice is also an attempt to resolve a complaint without going to the Forum ie if the service provider is willing to provide compensation or other remedies.

STEP 2: Get Organized Consumer Complaint

If the service provider is unwilling to provide compensation or other remedies, the next step is to file a formal complaint under the Consumer Protection Act, 1986. An appeal does not need to be an attorney.

A complaint may be lodged by a victim. The following details must be specified in the appeal:

Name, description and address of the complainant (s) and the Opposition or parties.

Cause of Action, date, time and place.

The relevant facts are related to the cause of the action.

Assistance or remedy sought by the plaintiff in accordance with the facts of the case.

Signature and confirmation by the complainant or his authorized agent.

STEP 3: Attach Relevant Documents

Copies of the physical evidence and relevant documents supporting your case in the Consumer Court are important. These documents include:

Copy of credit, delivery receipt, product installation, online booking record of purchased goods.

Warranty certificates / Certificates.

A copy of the written complaint and notice sent to the manufacturer/seller.

STEP 4: Appropriate Forum

Select the appropriate venue to lodge a complaint based on the competent power that is limited to the total amount of goods or services purchased or available and the amount of compensation claimed.

STEP 5: Pay the Court Application Fee

The prescribed fee is required to be paid along with the appeal lodged according to the forum. The amount of the court depends on the value of the goods purchased and the amount of compensation claimed.

STEP 6: Submit an Affidavit

A person who wants to sue in a Consumer Court is also required to file an affidavit in court. The affidavit must state that the facts presented and the statements made by the consumer are true to their knowledge.
