Most Common Questions on PoSH
What are the mandatory, non-negotiable PoSH compliances for a company?
Every organization with 10 or more employees has three primary legal duties:
Constitute an Internal Committee (IC): You must form a compliant IC as per the Act’s specific composition rules.
Conduct Regular Training: You must provide awareness programs for all employees and specialized training for your IC members.
File an Annual Report: You are required to submit an annual compliance report to the District Officer detailing complaints received and actions taken.
What really happens if we are non-compliant with the PoSH Act?
The financial penalty for non-compliance (like failing to form an IC) starts at up to ₹50,000. However, the business risks are far greater, including license suspension or cancellation, severe public reputational damage, and direct accountability risks for leadership.
What is an "External Member" and is it mandatory for our Internal Committee?
Yes, it is mandatory. The External Member is an impartial, third-party expert (like a lawyer or social worker) who sits on your IC to ensure inquiries are fair, unbiased, and legally sound. Adjuva Legal provides this critical service by empaneling one of our certified experts as the External Member for your IC.
Our employees are remote. Does PoSH apply to harassment on WhatsApp or Zoom?
Absolutely. Courts have repeatedly affirmed that the “workplace” includes all virtual and remote interactions. Harassment over digital channels is a serious compliance risk. Our services ensure your PoSH policy is drafted to explicitly cover this “virtual workplace” and that your employee awareness sessions address these modern, real-life scenarios.
Our employees find PoSH training "boring." What makes your sessions effective?
We believe PoSH training is about empowerment, not fear. Our sessions are interactive and based on real-life scenarios, not dry legal lectures. They are “designed to promote trust, transparency, and gender sensitivity”. Our expert trainers, with decades of combined legal and corporate training experience, create a safe, non-judgmental environment that builds a confident, protected culture.
We already have a PoSH policy. Isn't that enough for compliance?
A policy is just the first step. The law also mandates you form a compliant IC, conduct regular training for all employees and IC members, and file an Annual Report. Adjuva Legal offers a Year-Round Retainer to manage this entire compliance lifecycle for you, from IC constitution and training to annual filing and case handling support.
What is the difference between "Employee Awareness" and "IC Training"?
This is a critical distinction.
Employee Awareness Sessions (which we provide) are for all employees. They are designed to build a safe culture by explaining what PoSH is, what constitutes harassment (including in a remote/virtual context), and how to report an incident.
IC Training & Certification (our specialty) is an advanced, quasi-judicial training only for your Internal Committee members. It certifies them on how to legally handle a complaint, conduct an inquiry, gather evidence, maintain confidentiality, and write a final, legally-binding reportt.
What is the correct legal procedure for handling a PoSH complaint?
Once a complaint is received, a strict legal timeline begins. The basic procedure is:
Acknowledge: The IC must acknowledge the complaint in writing.
Inquiry: The IC must complete its entire investigation within 90 days.
Natural Justice: The IC must give both parties (complainant and respondent) a fair opportunity to be heard and present their evidence.
Report: The IC must submit its final inquiry report with recommendations to the employer within 10 days of completing the inquiry. Our Case Handling & Documentation service guides your IC through every step of this high-stakes process.
What is a "PoSH Retainer" and how does it benefit our company?
A PoSH Retainer (our Year-Round Compliance service) is the most effective way to ensure 100% compliance with minimal effort. Instead of worrying about individual tasks, you pay a single annual fee, and Adjuva Legal handles everything. This typically includes:
Empanelment as your External Member.
Conducting all mandatory Employee Awareness Sessions.
Providing IC Training & Certification.
Preparation and filing of your Annual PoSH Report.
On-call support for any case handling or documentation needs. It is a complete “peace of mind” solution for your organization’s leadership.
We are a small startup with only 12 employees. Do these PoSH rules still apply to us?
Yes. The law is exactly the same for an organization with 10 employees as it is for one with 10,000. As soon as you cross the 10-employee threshold, you are legally required to form an Internal Committee, conduct training, and file an Annual Report. We specialize in helping start-ups and small businesses get this right from day one.
